In plain English

In plain English

SEBI checks a list of eligibility conditions before it registers an AIF. The constitution document (memorandum, trust deed or LLP deed) must permit AIF activity and bar any invitation to the public. A trust deed must be registered under the Registration Act, 1908, and an LLP must be incorporated with its deed filed. The applicant, sponsor and manager must be fit and proper. The manager's key investment team needs at least one person with the certification SEBI specifies (not required for an accredited-investors-only fund) and at least one person with a recognised professional qualification. The manager or sponsor must have the infrastructure and people to run the fund, and the application must clearly describe the objective, target investors, proposed corpus, strategy and tenure.
